Terms of Service

These Terms govern your use of FitJournal, a workout tracking app for iOS and Android
(the “App”). The App is published by Sultan Seidalin, an individual developer
(“we”, “us”). You can reach us at seidalins@gmail.com.
By creating an account or using the App you agree to these Terms. If you do not agree, do not use the App.
1. Not medical advice
FitJournal is a logbook, not a healthcare product. It records what you tell it and does
arithmetic on it — estimated one-rep max, training volume, calories, step counts read from Apple Health.
Those numbers are estimates produced by standard formulas. They are not a diagnosis, a prescription, or a
training programme designed for you.
- Consult a physician before starting or changing an exercise programme, especially if you have an injury, a medical condition, or are pregnant.
- Never disregard professional medical advice because of something the App displayed.
- You train at your own risk. Weight training carries a real risk of injury.
Automated coaching suggestions
The App may show optional, automatically generated suggestions about your next set (for example, a weight
or rep target), produced by a third-party AI model from your recent sets for that exercise. These suggestions
are generated by software, are not reviewed by a human, may be wrong, and are not personal training advice.
Treat them as a prompt to think, not an instruction to follow.
2. Your account
- You need an account to use the App. You sign in with your Google or Apple account — we never handle a password.
- You are responsible for keeping access to your sign-in method secure, and for activity under your account.
- One account per person. Do not share it, sell it, or let someone else use it.
- Give us accurate information. If your email address is wrong, we cannot help you recover your account.
3. Minimum age
You must be at least 13 years old to use FitJournal. If you are between 13 and the age of
digital consent in your country (16 in some parts of the EU/EEA), you may only use the App with the consent of
a parent or guardian. We do not knowingly collect data from children under 13; if we learn that we have, we
delete the account.
4. Your content stays yours
Your workouts, journals, notes, comments, body measurements, custom exercises and photos are your
content. We claim no ownership of it. You grant us only the narrow, revocable permission needed to
operate the App for you: to store your content, to sync it between your devices, and to back it up. We do not
sell it, publish it, or use it to train AI models. That permission ends when you delete the content or your
account.
You are responsible for what you put in the App. Do not upload anything unlawful, anything that infringes
someone else's rights, or photos of other people who have not agreed to it.
5. Subscriptions and the free allowance
What is free
FitJournal is free to download and gives you an allowance of free logged workouts
(currently 10). The allowance is consumed when you log your first set of a workout, not when you press start.
A workout already in progress is never cut off mid-session — once it has a set in it, you can finish it.
What Premium unlocks
A Premium subscription removes the workout limit. Everything else in the App is available to everyone.
Important — the allowance is once per account. If you have ever held a FitJournal
subscription, including a promotional or trial subscription that has since ended, your free allowance is
zero and you need an active subscription to log new workouts. The free workouts are the trial.
Billing
- Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), not by us. Payment is charged to your store account at confirmation of purchase.
- Prices, durations and any promotional offer are shown in the App before you buy, and are the ones your store displays at that moment.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Cancel in your Apple ID or Google Play account settings — we cannot cancel it for you.
- Deleting the App does not cancel a subscription.
- Use Restore purchase in the App after reinstalling or changing devices, so long as you use the same store account.
Refunds
Refunds are handled by Apple and Google under their policies; we cannot issue them. If you are a consumer in
the EU/EEA or the UK, your statutory right of withdrawal applies as provided by law — exercise it through the
store you bought from, or contact us and we will help you.
Changes to the free allowance
We may change the size of the free allowance or what Premium unlocks. Changes apply going forward. An
active paid subscription keeps what it was sold with for its current period.
6. Acceptable use
Do not: reverse engineer, decompile or tamper with the App except where law expressly allows it; access the
backend other than through the App; scrape, bulk-download or interfere with other users' data; probe or attack
our infrastructure; automate account creation; or use the App to break the law.
7. Availability, and things we do not promise
FitJournal stores your data on your device first and syncs it to our servers in the background, so the App
keeps working offline. We still cannot promise the service will be uninterrupted, that sync will always
succeed, or that data will never be lost. Keep your own backup of anything you cannot afford to
lose. The App is provided “as is” and “as available”, without warranties beyond those that cannot be
excluded by law.
8. Liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, lost data,
lost profits, or personal injury arising from your training. Where liability cannot be excluded, it is limited
to the greater of the amount you paid us for the App in the 12 months before the claim, or EUR 50.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or
for anything else that cannot lawfully be limited.
9. Ending it
- You can stop at any time: delete your account in Settings, or just stop using the App. What deletion does is described in the Privacy Policy.
- We may suspend or terminate an account that breaches these Terms, or if we have to stop offering the App. Except where you have seriously breached these Terms or the law, we will give you reasonable notice and a chance to get your data out.
- If we discontinue FitJournal, we will give notice in the App or by email where we can.
10. Changes to these Terms
We may update these Terms. The “Last updated” date at the top always reflects the current version. For
changes that materially reduce your rights we will give notice in the App before they take effect. Continuing
to use the App after that means you accept the new Terms.
11. Governing law and your rights as a consumer
These Terms are governed by the law of Kazakhstan, except that if you are a consumer, you
keep the protection of the mandatory consumer-law provisions of the country you live in, and nothing here
deprives you of them. If you live in the EU/EEA or the UK, that includes your rights under EU/UK consumer and
data-protection law, and you may bring proceedings in the courts of your own country. The EU Online Dispute
Resolution platform is at

If any part of these Terms is unenforceable, the rest stays in force.
